BuildTom marketplace terms, conditions, rules, and responsibilities.
These Terms & Conditions govern access to and use of BuildTom. The Arabic version prevails if there is any ambiguity, conflict, or difference in interpretation.
1. Introduction and Acceptance
These Terms of Service govern access to and use of BuildTom.
By accessing or using BuildTom, creating an account, posting a listing, contacting another user, saving a listing, following an advertiser, submitting a report, purchasing or using a paid feature, or otherwise using the platform, you agree to these Terms.
If you do not agree to these Terms, you must not access or use BuildTom.
2. Definitions
In these Terms:
“BuildTom” means the BuildTom platform, website, services, features, pages, tools, and related digital services.
“User” means any person who accesses or uses BuildTom, whether registered or unregistered.
“Account” means a personal or company-related user account on BuildTom.
“Company Account” means a profile, workspace, or account representing a business entity.
“Listing” means any advertisement, post, offer, item, service, material, product, equipment, machinery, tool, scrap, asset, or related content published on BuildTom.
“Content” means text, images, documents, files, information, listings, messages, reports, evidence files, and other materials submitted, uploaded, displayed, or processed through BuildTom.
“Paid Service” means any paid feature, premium advertisement, subscription, credit, grant, payment service, RFQ service, wallet service, booking service, escrow service, checkout feature, or other paid or promotional service offered by BuildTom.
“Platform Policies” means these Terms, the Privacy Policy, Payment Policy, Safety Rules, and any other rules or policies published by BuildTom.
3. Arabic and English Versions
BuildTom’s Terms of Service, Privacy Policy, and Payment Policy will be made available in Arabic and English.
If any ambiguity, inconsistency, conflict, or difference in interpretation arises between the Arabic and English versions of these documents, the Arabic version shall prevail for the purposes of interpretation.
4. Age Requirement and Legal Capacity
By using BuildTom, creating an account, posting a listing, contacting another user, submitting a report, or using any marketplace feature, you confirm that you are at least 18 years old and legally capable of using the platform and entering into marketplace communications.
If you are under 18 years old, you must not create an account, post listings, contact users, submit reports, or use BuildTom services.
If you use BuildTom on behalf of a company or legal entity, you confirm that you are legally authorised to act on behalf of that company or legal entity and to bind it to these Terms.
5. Platform Role
BuildTom provides an online listing and technology platform for construction materials, equipment, machinery, tools, scrap, and other approved categories.
The platform allows users to publish listings and contact each other directly.
Unless expressly stated otherwise in separate applicable terms, BuildTom is not a seller, buyer, renter, owner, broker, commercial agent, inspector, certifier, carrier, payment processor, escrow provider, guarantor, or party to any transaction between users.
Any purchase, sale, rental, inspection, delivery, payment, warranty, refund, return, ownership verification, safety verification, or dispute is the responsibility of the relevant buyer and seller, or renter and owner.
6. User Responsibility
Users are responsible for all information, content, descriptions, prices, images, specifications, certificates, permits, ownership statements, safety statements, contact details, locations, availability, item condition, and documents they provide through BuildTom.
Users must ensure that their listings and other content are true, accurate, sufficiently complete, current, lawful, and not misleading.
Users must not post false, fraudulent, illegal, unsafe, stolen, counterfeit, prohibited, restricted, offensive, inappropriate, or unauthorised listings or content.
Users are responsible for ensuring that they own the advertised item or are legally authorised to advertise it and that their listing and activities comply with applicable UAE federal and local laws, including Dubai requirements where applicable.
7. Ownership and Authority to Advertise
By posting a listing on BuildTom, you confirm that:
- You are the lawful owner of the advertised item, product, material, equipment, machinery, tool, scrap, or asset; or - You are legally authorised by the lawful owner or relevant company to advertise it; or - In the case of a service, you are legally authorised and appropriately licensed, where required, to offer that service.
You must not advertise any item that is stolen, counterfeit, disputed, seized, subject to an ownership claim, subject to third-party rights, or otherwise restricted from sale, rental, transfer, or disposal.
You must not advertise an item that is financed, leased, pledged, mortgaged, subject to retention of title, or otherwise encumbered unless you have full legal authority and all required consents to advertise and complete the proposed transaction.
BuildTom may request ownership records, authorisation letters, company approvals, financing clearances, or other supporting documents.
8. Listing Rules
Users may create, renew, repost, or purchase separate placement for the same or a similar item, including a paid Premium listing. Each listing must remain true, current, lawful, and sufficiently clear.
BuildTom does not reject a listing merely because the same item or a similar item was listed before. Each paid Premium submission is treated as a separate service order and listing lifecycle.
Users must not use repeated listings to mislead users, impersonate another person, conceal that an item is unavailable, evade an account or safety restriction, manipulate reviews or reports, or publish unlawful content. BuildTom may group, rank, label, limit the simultaneous visibility of, or request corrections to repeated listings when reasonably required for marketplace usability or safety.
If a paid Premium listing is finally rejected before its first publication for any reason, the Premium Direct fee for that submission is eligible for a full refund to the original payment method. The user may correct the listing or create another listing and may purchase Premium again as a separate order.
9. Prohibited and Restricted Listings
Users must not advertise any item, service, material, or content that is prohibited, restricted, unlicensed, or unlawful in the UAE.
Prohibited or restricted listings may include:
- Stolen or suspected stolen items. - Counterfeit goods or unauthorised replicas. - Unsafe or recalled products. - Weapons, explosives, or prohibited dangerous goods. - Hazardous, flammable, chemical, radioactive, contaminated, or regulated materials where listing or dealing in them is prohibited or where required approvals are not held. - Asbestos or asbestos-containing materials. - Regulated waste or construction and demolition waste where required licences or permits are not held. - Forged, falsified, expired, or misleading documents or certificates. - Confidential, private, or unlawfully obtained documents. - Products or content that infringe intellectual property rights. - Items requiring a licence, permit, registration, approval, or certification that the user does not hold. - Any item or service that violates UAE public order, public morals, safety requirements, environmental requirements, or applicable law.
BuildTom may reject, remove, hide, restrict, or suspend a listing that falls or may fall within a prohibited or restricted category.
BuildTom may request supporting documents before permitting or continuing the publication of a restricted listing.
10. Used, Refurbished, Damaged, or Scrap Items
Listings on BuildTom provide a preliminary description of the advertised item and are not a substitute for a physical inspection, technical assessment, or final written agreement between the transaction parties.
Unless otherwise required by applicable law or the relevant listing category, a listing is not required to contain every technical, operational, commercial, delivery, or contractual detail concerning the item.
Where applicable, the advertiser must clearly and accurately identify the general condition of the item, including whether it is:
- Used. - Refurbished. - Repaired. - Damaged. - Defective. - Incomplete. - Non-operational. - For parts only. - Scrap.
The advertiser must not knowingly provide false or misleading information or conceal a known material defect or safety risk that materially affects the item’s use, value, condition, legality, or safety.
Users are responsible for inspecting the item, requesting further information and documents, and agreeing directly outside BuildTom on its final condition, specifications, defects, price, warranty, delivery, payment, acceptance, and all other transaction terms.
Users should document their final agreement through a separate written contract, inspection report, invoice, delivery note, acceptance document, or other transaction record.
A listing is a preliminary description and advertisement and does not by itself constitute an inspection certificate, a guarantee by BuildTom, or the complete final agreement between the users.
11. Construction Equipment, Materials, and Safety
BuildTom does not inspect, test, certify, maintain, repair, operate, transport, install, dismantle, supervise, or guarantee any construction material, equipment, machinery, vehicle, tool, spare part, scrap, or other asset listed on the platform.
Sellers, owners, buyers, renters, and other users are responsible for:
- Inspecting the item. - Verifying its ownership and condition. - Confirming its safety and suitability. - Reviewing specifications and maintenance history. - Checking certificates, permits, manuals, and usage restrictions. - Ensuring that qualified and authorised persons operate or install the item. - Complying with applicable health, safety, technical, and regulatory requirements.
Users must not advertise an item where its advertisement, sale, rental, transfer, transport, or use is prohibited by law.
Where an item may lawfully be sold for repair, dismantling, recycling, spare parts, or scrap, its condition and intended purpose must be clearly stated, and it must not be presented as safe or suitable for operational use when it is not.
BuildTom does not provide any warranty regarding the condition, fitness, merchantability, legality, ownership, safety, or suitability of any listed item.
Any warranty, if offered, is provided only by the relevant user and must be agreed directly between the transaction parties.
12. Scrap, Waste, and Environmental Compliance
Listings involving scrap, recyclable materials, demolition materials, industrial materials, used parts, waste, hazardous waste, construction and demolition waste, or environmentally regulated materials must comply with applicable UAE federal and local environmental, municipal, transport, recycling, disposal, and waste-management requirements.
Users are responsible for determining whether a material requires:
- A licence or permit. - An environmental approval. - An approved transporter. - An approved recycling or disposal facility. - A municipality approval. - A movement or disposal record. - Any other regulatory authorisation.
BuildTom does not issue environmental or waste-management approvals and does not authorise, supervise, or guarantee the legality of any scrap, waste, recycling, transport, storage, treatment, or disposal activity.
13. Customs, Import, Export, and Restricted Goods
Users are responsible for ensuring that any imported, exported, re-exported, customs-controlled, or restricted item has been lawfully declared, cleared, and approved where required.
Users must comply with applicable:
- Customs requirements and duties. - Import and export controls. - Re-export requirements. - Restricted-goods rules. - Sanctions and trade restrictions. - Competent-authority approvals. - Product registration or conformity requirements.
BuildTom may request proof of customs clearance, import or export permits, ownership documents, invoices, certificates, or regulatory approvals.
BuildTom may reject, hide, suspend, or remove a listing if satisfactory supporting documents are not provided.
14. Prices, Taxes, Delivery, and Additional Costs
Unless clearly stated by the advertiser, listing prices may exclude VAT, customs duties, transport, loading, unloading, dismantling, installation, inspection, permits, insurance, and third-party costs.
Users must confirm all prices, taxes, charges, delivery arrangements, loading or unloading costs, inspection costs, and commercial terms directly with each other before entering into any transaction.
BuildTom does not verify or guarantee the accuracy of prices, tax treatment, delivery charges, or additional costs stated by users.
15. Safety Rules and Reporting to Authorities
Users must independently verify the product, seller, buyer, documents, ownership, condition, location, payment terms, delivery arrangements, permits, and safety requirements before completing a transaction.
Users should avoid sending advance payments to unknown parties unless they have properly verified the other party and the proposed transaction.
For high-value or safety-sensitive transactions, users should use written agreements, invoices, receipts, independent inspections, and qualified professional advice.
If you believe that a crime, fraud, theft, unsafe activity, or legal violation has occurred, you should report the matter directly to the appropriate UAE authority, which may include the police, consumer protection authority, municipality, customs authority, environmental authority, or another competent authority depending on the circumstances.
BuildTom may review reports and take platform-level actions, including:
- Hiding or removing a listing. - Requesting documents or clarification. - Restricting or suspending an account. - Preserving relevant platform records. - Restricting access to platform features. - Cooperating with competent authorities where required or permitted by law.
BuildTom is not a law enforcement authority, court, regulator, police authority, investigation authority, or dispute-resolution body.
BuildTom’s internal actions do not replace official reporting, legal proceedings, regulatory action, or action by competent authorities.
16. User Communications Outside the Platform
Users are responsible for their communications, negotiations, inspections, meetings, agreements, payments, deliveries, and disputes with other users, whether such interactions occur through BuildTom, by phone, WhatsApp, email, in person, or outside the platform.
BuildTom does not control or supervise communications, meetings, negotiations, payment arrangements, delivery arrangements, or agreements made outside the platform.
Users should be cautious when sharing personal information, financial information, documents, payment details, or location information with other users.
17. Payments and Transactions Between Users
BuildTom does not process, receive, hold, transfer, supervise, verify, or guarantee marketplace payments between buyers and sellers or between renters and owners.
Any payment arrangement, deposit, advance payment, instalment, refund, invoice, tax, delivery charge, warranty arrangement, or other transaction term is agreed and completed directly between the relevant users outside BuildTom.
BuildTom is not a party to and does not control the content, price, payment method, inspection, delivery, warranty, refund, cancellation, or other terms of a transaction between users.
To the maximum extent permitted by applicable UAE law, BuildTom is not responsible for failed payments, payment fraud, non-delivery, product defects, incorrect descriptions, cancelled deals, refund disputes, warranty disputes, or other disputes between users.
18. Paid Services and Payment Policy
BuildTom may provide optional paid platform services. At the current UAE launch boundary, Regular listings are free and Premium Direct is an optional one-time paid service for one Premium listing review submission and listing lifecycle.
The initial Premium Direct price is AED 50.00. The current price, currency, included benefits, and applicable conditions are displayed before checkout and may be changed by BuildTom for future purchases. A price change does not rewrite a completed order, payment, invoice, refund, or other historical evidence.
A Premium payment purchases the review and Premium feature for the submitted listing. It does not guarantee approval, the first search position, a fixed ranking, a minimum number of views or enquiries, or a completed marketplace transaction.
The listing is saved privately before checkout. No Premium service is activated unless BuildTom receives verified paid evidence from the payment provider for the exact locked amount and currency.
If a paid Premium listing is finally rejected before its first publication for any reason, BuildTom will provide a full refund of the Premium Direct fee to the original payment method, subject to provider processing time and applicable law. Repeated or reposted listings are permitted, and each paid Premium submission is a separate order.
Subscription purchases, public Top-up purchases, paid Company Workspace ownership-transfer checkout, marketplace escrow, and buyer-to-seller payment processing remain unavailable unless BuildTom expressly activates them and publishes their specific terms.
BuildTom is not currently registered for UAE VAT and does not display a TRN or charge VAT while that status remains unchanged. Any mandatory legal right overrides a conflicting contractual term.
19. Premium Ads, Credits, Grants, and Promotional Features
BuildTom may provide free posting credits, administrative grants, premium advertisement credits, trial offers, paid plans, promotional access, or other promotional features.
Such features may be subject to eligibility rules, usage limits, display rules, availability restrictions, expiry dates, and additional terms.
Premium placement or paid visibility may increase exposure within BuildTom but does not guarantee:
- Views. - Enquiries. - Leads. - Sales. - Rentals. - Revenue. - Search ranking. - Transaction completion. - Business results.
Credits, grants, and promotional access may have no cash value, may be non-transferable, may expire, and may be limited to specific accounts, listings, categories, or periods.
The applicable conditions will be stated in the Payment Policy, promotional offer, account notice, or relevant service terms.
If a listing is removed, rejected, suspended, or restricted because it violates these Terms or platform policies, a related premium or promotional feature may also be removed or suspended in accordance with the applicable Payment Policy and UAE law.
20. Account Activation and Verification
BuildTom may require users to complete account details before posting listings or using particular features.
Required information may include:
- Name. - Email address. - Phone number. - Phone verification through OTP. - Account information. - Other information reasonably required for account operation, security, or compliance.
Company accounts may require additional information, trade licence details, authorisation documents, company contact details, supporting documents, or administrative approval before company features are activated.
Submitting information or documents does not guarantee account activation or continued access to a feature.
BuildTom processes account, verification, and company information in accordance with the BuildTom Privacy Policy.
21. Company Accounts
A user account represents a real person. A company profile represents a separate business entity.
Users who create, manage, or post on behalf of a company confirm that they are legally authorised to do so.
BuildTom may request:
- Trade licence information. - Authorisation letters. - Identity documents. - Ownership records. - Product certificates. - Safety certificates. - Permits. - Company contact information. - Other supporting documents.
BuildTom may enable, disable, approve, reject, suspend, limit, or review company features based on platform rules, safety concerns, documentation, compliance requirements, or suspected misuse.
Company documents submitted privately to BuildTom will be handled in accordance with the Privacy Policy and will not be published as listing content unless the user expressly authorises publication or disclosure is required or permitted by law.
22. Reports and Platform Moderation
Users may report suspicious, misleading, inappropriate, unsafe, illegal, stolen, fraudulent, infringing, prohibited, or restricted listings, accounts, documents, content, or activities.
BuildTom may review reports and take platform-level action, including:
- Requesting clarification or documents. - Hiding listings. - Returning listings for correction. - Removing content. - Restricting or suspending accounts. - Suspending platform features. - Preserving relevant records. - Cooperating with competent authorities where required or permitted by law.
Submitting a report does not guarantee a particular action, result, response, or resolution.
BuildTom reviews reports based on available information, applicable law, these Terms, and platform policies.
BuildTom is not a law enforcement authority, court, regulator, police authority, investigation authority, or dispute-resolution body.
23. No General Monitoring Obligation
BuildTom may review, moderate, approve, reject, remove, hide, restrict, or suspend content, listings, accounts, or platform features.
However, BuildTom is not under a general obligation to monitor all listings, users, communications, documents, transactions, or external dealings between users.
Users remain responsible for their own content, listings, communications, documents, and transactions.
Any moderation, approval, rejection, or review by BuildTom is performed for platform, safety, policy, or compliance purposes and does not make BuildTom responsible for the underlying listing, item, document, user, or transaction.
24. Prohibited Use
Users must not use BuildTom for or in connection with:
- Illegal activity. - Fraud or attempted fraud. - Spam or unsolicited communications. - Harassment, threats, abuse, or intimidation. - Impersonation. - Posting stolen, counterfeit, unsafe, prohibited, or unlawfully restricted items. - Uploading forged, misleading, or malicious files. - Collecting data without authority. - Scraping or automated extraction. - Attempting to bypass platform controls. - Interfering with platform availability or security. - Introducing malware or harmful code. - Manipulating accounts, listings, reports, rankings, or promotional features. - Violating public order or public morals. - Violating intellectual property, privacy, or data-protection rights. - Violating product-safety, environmental, waste-management, customs, or other applicable UAE requirements.
Users must not encourage, assist, or enable another person to engage in prohibited use.
25. No Scraping and Data Misuse
Users must not, without BuildTom’s prior written consent:
- Scrape or crawl BuildTom. - Harvest or extract platform data. - Copy or index listings through automated means. - Download content in bulk. - Compile a database from platform content. - Collect phone numbers, WhatsApp numbers, emails, or company details. - Sell or commercially exploit platform data. - Use platform information to send spam. - Create unauthorised marketing or contact lists. - Contact users for unrelated commercial purposes. - Circumvent technical measures intended to prevent data extraction.
This restriction applies to listings, profiles, prices, images, descriptions, contact information, company details, reports, and other BuildTom content.
26. Intellectual Property and Confidential Content
Users retain ownership of the content they lawfully upload, subject to the licence granted under these Terms.
Users must only upload or publish content, images, logos, trademarks, drawings, plans, technical sheets, certificates, manuals, documents, and other materials that they own or are legally authorised to use and publish.
Users must not upload confidential, proprietary, copyrighted, trademarked, restricted, private, forged, or unauthorised documents or content.
By uploading public listing content to BuildTom, the user grants BuildTom a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display, communicate, distribute, moderate, and use that public content for the purposes of:
- Operating the platform. - Displaying and promoting the listing. - Moderating content. - Supporting platform functionality. - Promoting BuildTom. - Improving BuildTom services.
This licence applies only to public listing content and does not automatically apply to private identity documents, trade licences, verification documents, authorisation letters, private reports, or evidence files submitted confidentially to BuildTom.
27. Privacy and Personal Data
BuildTom may collect and process account information, contact details, OTP verification data, company information, documents, listing content, reports, evidence files, usage data, technical data, and acceptance records as described in the BuildTom Privacy Policy.
The Privacy Policy explains the categories of personal data collected, the purposes of processing, disclosures to service providers or competent authorities, retention periods, security measures, and applicable data-subject rights.
Users must not scrape, collect, misuse, sell, disclose, spam, or otherwise unlawfully process the personal data of other users.
Users must only use another user’s contact information for legitimate communications directly related to a listing, enquiry, transaction, report, or other permitted BuildTom activity.
28. Third-Party Services
BuildTom may use, integrate with, or link to third-party services, including:
- Hosting providers. - Database providers. - Email and communication providers. - OTP providers. - Map services. - Analytics providers. - Payment processors. - WhatsApp. - External websites or applications.
Third-party services may be subject to their own terms, privacy policies, availability, restrictions, and technical requirements.
To the maximum extent permitted by applicable UAE law, BuildTom is not responsible for the independent operation, availability, security, policies, content, or conduct of third-party services.
29. Service Availability, Interruptions, and Force Majeure
BuildTom aims to keep the platform available and functioning, but it does not guarantee that the platform will always be available, uninterrupted, error-free, secure, or free from technical issues.
BuildTom may suspend, limit, interrupt, modify, or stop access to all or part of the platform for maintenance, updates, security, technical, legal, operational, or compliance reasons.
To the maximum extent permitted by applicable UAE law, BuildTom shall not be responsible for any delay, interruption, failure, data loss, service unavailability, feature unavailability, or inability to access or use the platform caused by events beyond BuildTom’s reasonable control.
Such events may include, without limitation:
- Natural disasters. - Fire or flood. - War or civil disturbance. - Government action. - Regulatory action. - Legal restrictions. - Internet failure. - Telecommunications failure. - Power outage. - Cyberattack or malware. - Cloud service failure. - Hosting provider failure. - Database provider failure. - Payment processor failure. - Third-party service failure. - Labour disruption. - Epidemic or pandemic. - Other force majeure events.
BuildTom may take reasonable steps to restore or maintain platform functionality, but it does not guarantee any specific recovery time, availability level, or uninterrupted access.
30. No Professional Advice
BuildTom does not provide engineering, technical, occupational-safety, valuation, inspection, legal, environmental, customs, tax, financial, or other professional advice.
Technical specifications, descriptions, images, certificates, permits, reports, or documents displayed on BuildTom are generally provided by users and must be independently reviewed and verified by the relevant parties.
Users should obtain advice or inspections from appropriately qualified and authorised professionals where necessary.
31. Electronic Acceptance
By creating an account, posting a listing, clicking an acceptance checkbox, activating a company profile, purchasing or using a paid feature, or otherwise completing an electronic acceptance step, you agree that electronic records may be used to document your acceptance and activity.
Such records may include:
- Acceptance confirmations. - OTP verification records. - Timestamps. - Account identifiers. - Listing identifiers. - Policy version records. - Transaction or payment confirmations. - Relevant platform logs.
These records may be used as evidence to the extent permitted by applicable UAE law.
32. User Indemnity
To the maximum extent permitted by applicable UAE law, you agree to indemnify and hold harmless BuildTom, its owner, shareholders, directors, officers, employees, contractors, affiliates, agents, and representatives from and against any claims, complaints, demands, liabilities, losses, damages, penalties, fines, costs, and expenses, including reasonable legal fees, arising out of or related to:
- Your listing, content, documents, or communications. - Your use of BuildTom. - Your transaction, negotiation, inspection, payment, delivery, or dispute with another user. - Your breach of these Terms or platform policies. - Your violation of any law, regulation, permit, licence, approval, or third-party right. - Your misrepresentation, fraud, negligence, or misconduct. - Any item, product, material, equipment, machinery, tool, scrap, waste, or service you advertise, sell, rent, provide, transfer, transport, or dispose of.
33. Limitation of Liability
BuildTom provides an online listing and technology service.
To the maximum extent permitted by applicable UAE law, BuildTom shall not be liable for:
- User-to-user transactions. - Listing content. - The condition or quality of any listed item, commodity, material, equipment, asset, or service. - Ownership disputes. - The safety or legality of any listed item. - Delivery or non-delivery. - User payments or payment losses. - Warranties or representations made by users. - Prices or availability. - Seller, buyer, renter, lessor, or owner conduct. - Cancelled deals. - Disputes between users. - Decisions made by users based on listing content. - External communications or agreements between users. - Third-party service availability or conduct, except where applicable law provides otherwise.
BuildTom does not guarantee that any listing, premium feature, company profile, contact, message, report, or platform feature will result in a sale, rental, enquiry, lead, payment, delivery, profit, successful transaction, or dispute-free outcome.
34. Account Suspension, Restriction, and Termination
BuildTom may warn, restrict, suspend, disable, or terminate an account or limit access to platform features where BuildTom has reasonable grounds to believe that the user has violated these Terms, platform policies, applicable law, safety requirements, moderation rules, payment rules, or the rights of another person.
BuildTom may also take action where there is suspected:
- Fraud. - Misuse. - Security risk. - Unlawful activity. - Misleading content. - Repeated violations. - Failure to provide requested documents. - Attempts to bypass platform controls. - Conduct that may harm BuildTom, users, or the platform.
Account restriction, suspension, or termination may affect active listings, premium features, credits, access to a company account or workspace, reports, saved items, messages, or other platform features, subject to the applicable Payment Policy and Privacy Policy.
BuildTom may preserve records where reasonably necessary for security, compliance, dispute handling, enforcement of these Terms, or cooperation with competent authorities, in accordance with the Privacy Policy and applicable law.
35. Changes to These Terms
BuildTom may update these Terms from time to time.
The updated Terms will state their effective date.
Where a change is material, BuildTom may provide notice through the platform, the user’s account, email, or another reasonable method.
Continued use of BuildTom after the effective date of updated Terms constitutes acceptance of those updated Terms.
If you do not agree to the updated Terms, you must stop using BuildTom.
BuildTom may request separate express acceptance for material changes or where required by applicable law.
36. Severability and No Waiver
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the maximum extent permitted by applicable law.
BuildTom’s failure or delay in enforcing any right, rule, remedy, or provision under these Terms does not constitute a waiver of that right, rule, remedy, or provision.
Any waiver must be clear and in writing to be effective.
37. Contact, Complaints, and Official Reporting
For reports, complaints, suggestions, support, or general contact, users may use the report or contact options available through BuildTom.
BuildTom may handle platform-related complaints at platform level, including:
- Reviewing a listing or account. - Requesting documents or clarification. - Hiding or removing content. - Restricting platform features. - Suspending an account. - Preserving relevant platform records.
BuildTom is not a law enforcement authority, court, regulator, police authority, investigation authority, or dispute-resolution body.
If a user believes that a crime, fraud, theft, safety incident, regulatory violation, environmental violation, customs violation, consumer-protection issue, or other legal violation has occurred, the user should report it directly to the relevant UAE authority.
38. Listing reclassification, deletion, and archive
BuildTom may correct a listing category, request missing category fields, or return a listing to review without changing the advertiser substantive offer. When a user selects Delete Ad, the listing is removed from public and default account views but retained internally as an archive for the applicable retention period. Commercial and statistical history, moderation evidence, reports, financial links, and audit records may remain. Exceptional redaction of unlawful, dangerous, highly sensitive, or legally restricted content is a separate controlled Admin action with audit evidence.
39. Account deletion and retention
Eligible account-deletion requests use a 30-day grace period. Personal identifiers may then be removed or anonymised, while non-personal commercial statistics and listing history, financial and tax records, disputes, reports, security records, fraud-prevention evidence, legal holds, and audit evidence may remain for the applicable retention period. A deletion request does not erase another party records or evidence that BuildTom must preserve by law or for legitimate platform protection.
40. Platform contact, company enquiries, and lawful requests
General support, complaints, privacy requests, platform notices, and company enquiries should use the Contact or Report channels available on BuildTom. A public company page does not display a general company phone; users contact a company through a published listing and its authorised contact fields. These channels do not restrict any person right or duty to contact a competent authority, and BuildTom may preserve or disclose records and respond to valid legal process where required or permitted by applicable law.
